Under California law, you can make no assumptions about who is presumed to be the father of a child. The courts often take a long look at some complicated issues.

Determining a Father Paternity

A man is presumed to be the father of a child if he was married to the mother at the time of conception. If the couple is married, there may still be cases of disputed paternity, however. If there is no marriage, but a man agrees to place his name on the birth certificate or to provide financial support of the child and care for the child as his own, the courts will consider him to be the father. Under California law, either party — father or mother — wishing to dispute paternity under either of the above circumstances must file a paternity lawsuit to prove that a male other than the name on the birth certificate is the father. If you are going through a paternity dispute, email us or call 888-959-8508.

Paternity and Child Support, Custody, and Parenting Rights

Child support, child custody and parenting rights all begin with determining the paternity of the baby. Whether you are a mother seeking to prove paternity in order to obtain child support payments or a father seeking visitation and parenting time under the law, you need to begin the process by obtaining official paternity status.

Trial Victory -- Fernandez & Lauby attorney, Brian Mankin recently prevailed at trial on an employee's individual unpaid wage claim in San Bernardino County Superior Court. The employee claimed that he was required to work more than 8 hours per day and/or 40 hours per week, but was only paid for 40 hours per week. He also claimed that he was given inaccurate wage statements. The employer claimed that it did not owe any additional wages. Mankin filed a lawsuit for failure to pay minimum wages and overtime wages, as well as failure to provide breaks and accurate wage statements. Following trial, the court awarded the employee his unpaid wages, interest and various penalties, plus the employer was required to pay approximately $60,000 in attorneys fees and costs to Fernandez & Lauby. If you were denied wages, misclassified, not given all required breaks or have any other concerns about your pay or working conditions, feel free to call, or email, the employment law team at Fernandez & Lauby for a free consultation. Most unpaid wage cases are handled by the firm on a contingency basis, meaning you don't pay unless you win.
