Undue Influence

A common tactic is to exert influence over an elderly person to be included in that person's will. If your elderly relative has changed the will to include a recent new friend or paramour, a relative who had previously been estranged from the elderly person or a complete stranger, undue influence might be at work.

For a will or other estate planning instrument to be valid, the testator (the person issuing the estate planning document) needs to be of sound mind and able to choose his or her beneficiaries with absolute freedom. When someone else exerts too much influence, or the wrong kind of influence, it can render the will void:

  • Threat of physical abuse
  • Threat of neglect or discontinuation of care from someone whom the elder person has become dependant
  • Psychological manipulation

Trial Victory -- Fernandez & Lauby attorney, Brian Mankin recently prevailed at trial on an employee's individual unpaid wage claim in San Bernardino County Superior Court. The employee claimed that he was required to work more than 8 hours per day and/or 40 hours per week, but was only paid for 40 hours per week. He also claimed that he was given inaccurate wage statements. The employer claimed that it did not owe any additional wages. Mankin filed a lawsuit for failure to pay minimum wages and overtime wages, as well as failure to provide breaks and accurate wage statements. Following trial, the court awarded the employee his unpaid wages, interest and various penalties, plus the employer was required to pay approximately $60,000 in attorneys fees and costs to Fernandez & Lauby.
