Brian Mankin is one of the more highly experienced employment law attorneys in Southern California, wherein he manages the firm’s employment and labor law practice. As a member of the California Employment Lawyers Association, he and his team primarily represent employees who have been subjected to unfair treatment in the form of unpaid wages, denied meal and rest breaks, misclassification, wrongful termination, discrimination and harassment. Brian has tried cases in state and federal courts, and has never lost a trial to date. A large portion of his practice involves class action litigation where he has represented groups of employees in over 100 cases in federal and state courts. Having practiced for nearly 20 years, Mr. Mankin is approaching $100 million in damages recovered for his clients (who often work as nurses, ambulance drivers, technicians, warehouse workers, truck drivers, sales, professional occupations and countless other trades). In 2017 alone, he and his team recovered approximately $25 million for his clients, including the largest known settlement to date in California’s history for penalties under PAGA (the Private Attorney General Act of 2004) – an 8-figure award that paid significant damages to the State and the employees.

Prior to becoming an attorney, Brian completed his undergraduate degree in San Diego and law degree in Orange County while serving as a military police officer in the California Army National Guard. Brian originally joined the firm in 2003, and he is admitted to practice before Federal and California courts, and is a member of local bar associations.

In his time away from the office, Brian, his wife and two children spend much of their time engaged in competitive racing activities whether on the road, at the track, or on the water. Just like the man he was named after (Brian Piccolo, former running back for the Chicago Bears and subject of the movie Brian’s Song), for Brian, the desire to compete and win doesn’t stop at the courtroom.

Trial Victory -- Fernandez & Lauby attorney, Brian Mankin recently prevailed at trial on an employee's individual unpaid wage claim in San Bernardino County Superior Court. The employee claimed that he was required to work more than 8 hours per day and/or 40 hours per week, but was only paid for 40 hours per week. He also claimed that he was given inaccurate wage statements. The employer claimed that it did not owe any additional wages. Mankin filed a lawsuit for failure to pay minimum wages and overtime wages, as well as failure to provide breaks and accurate wage statements. Following trial, the court awarded the employee his unpaid wages, interest and various penalties, plus the employer was required to pay approximately $60,000 in attorneys fees and costs to Fernandez & Lauby.
